5045 Drug Free Workplace
Pursuant to the requirements of the Drug Free Workplace Act of 1988
(Public Law 100-690, Title 5, Subtitle D), it is the policy of the
Hartnell Community College District to continue to provide a drug-free
workplace.
The unlawful manufacture, distribution, dispensing, possession or
use of a controlled substance is prohibited in the workplace which
includes all facilities under the control and use of the Hartnell
Community College District.
Any violation of this prohibition by an employee of the District may
result in (1) requiring such employee to participate satisfactorily
in a drug abuse assistance or rehabilitation program; or (2) disciplinary
action up to and including termination.
The Drug-Free Schools and Communities Act Amendments of 1989 (Public
Law 101-226), requires the District to sign a certification in order
to receive any Federal funds. The certification indicates the District
has adopted and implemented a program to prevent the illicit use of
drugs and the abuse of alcohol by students and employees. At a minimum,
this program must include the annual distribution of the following
to each student and employee:
- standards of conduct that clearly prohibit, at a minimum, the
unlawful possession, use, or distribution of drugs and alcohol by
students and employees on District property or as any part of District
activities;
- a description of the applicable legal sanctions under local, State,and
Federal law for unlawful possession, use, or distribution of illicit
drugs and alcohol;
- a description of any drug and alcohol counseling,
treatment, or rehabilitation programs that are available to students
and employees; and
- a clear statement that the District will impose sanctions on students
and employees (consistent with local, State, and Federal law) and
a description of these sanctions, up to and including expulsion
or termination of employment and referral for prosecution for violations
of the Penal Code relating to drug offenses.
